Please ensure you read the Terms and Conditions carefully before placing an order with The Rocky Road House. All orders placed through The Rocky Road House on-line ordering system will be bound by these Terms and Conditions.
You acknowledge and agree that The Rocky Road House will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from use of goods supplied to you, or on behalf of you.
You agree to indemnify and hold The Rocky Road House harmless from and against any and all claims, loss or expense that may be incurred by The Rocky Road House which relate to or are incidental to the performance of its duties as described in these Terms and Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.
Overdue fundraising and wholesale accounts will be subject to interest at the rate of 11.5%p.a. calculated for the period in which the account is due until the date it is paid in full. If in the event the account is not settled in full within 21 days after the due date the account will be referred to a collection agency and/or law firm, where you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.
The Rocky Road House reserves the right to change these Terms and Conditions without notice. Terms and Conditions published on our website will always be the latest and will override any prior Terms and Conditions provided in any other form.
All photos on The Rocky Road House website and social media sites are copyright either by The Rocky Road House or photographers who have supplied their photos for our gallery, and unauthorised copying and distribution of any of these photos is prohibited.
Delivery
The Rocky Road House offers world wide shipping, calculated based on the weight of each individual order at checkout. Delivery within Australia is 2-5 working days (excluding Saturdays and Sundays, Public Holidays), depending on delivery location. All international delivery turnaround times are 5-10 days (orders may be delayed if clearance is required by customs).
During peak periods such as Christmas, Easter, Valentine’s Day, Mother’s Day and Father’s we highly recommend all orders be placed as early as possible to avoid disappointment. During these peak seasons The Rocky Road House may choose to stipulate cut-off timeframes for orders. Cut off dates for Christmas 2021 is midnight AEDT 12th Dec 2021, all orders received from 13th Dec 2021 will be processed and dispatched from 10th Jan 2022.
The Rocky Road House cannot accept responsibility if the following circumstances arise:
Incorrect or incomplete delivery address is provided
Access to the delivery address cannot be gained (ie. Locked gates, unsafe due to dogs etc)
The Rocky Road House will not be held responsible for any loss or damage to products that have been left unattended. We highly recommend you provide us with alternative delivery instructions when placing your order if the intended recipient will not be at the delivery address so to prevent any incidents from occurring.
You agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation or refund of an order.
Transit Damage
Our delivery service is undertaken by either Australia Post or our selected couriers. Once our packages leave our warehouse and are in transit we have little control over them and the handling of the products contained within. Our couriers are reliable and are respectful of the products they are delivering, but in the rare event your packaged products get damaged, please contact us ASAP so that we can investigate with the couriers and if applicable arrange for a replacement to be delivered. All damaged products must be reported within 24 hours of receiving. All damaged products will be required to be returned to The Rocky Road House where they will be assessed before being replaced.
Pre- Orders
From time to time The Rocky Road house will introduce new product ranges and may offer these for pre-order. Pre-order means the product has a specific launch date and we are giving you the opportunity to pre-purchase the new product range prior to the launch so that you are one of the first to taste the new product range. When pre-orders are offered it will be noted on our website (via shop, cart and checkout pages) the date that first orders will be dispatched which is in line with the launch date. The Rocky Road House reserves the right to amend this date if needed and communicate any amendments in relation to the launch and your pre-order dispatch date via our website and our social media platforms.
Changes to Your Order
Changes to an order that has already been placed will depend on what stage you order is at. Please contact us ASAP to discuss your changes and we will be able to advice you if it is at all possible, we will in any case try our best.
Cancellation and Refunds
Unfortunately we are unable to offer a refund unless the goods delivered are damaged in transit (refer above).
In the event when The Rocky Road House are unable to supply the order on the agreed date due to unforeseen circumstances (for reasons including, but not limited to, illness, accident, injury, or bereavement), we reserve the right to cancel the order and will provide you with a full refund.
Allergy Information
Our products at The Rocky Road House are gluten, egg and peanut free. Please be aware that our products contain soy and dairy and MAY contain traces of tree nuts. It is the client’s responsibility to inform their guests that traces of these products could be present. The Rocky Road House will not be held responsible for anyone suffering from allergies to these products. All products are listed with specific allergy advice.

Payment details are captured online using strong SSL certificate technology, which encrypts all information to make it secure.
Client’s Obligation
To read this terms and conditions thoroughly and carefully. By using The Rocky Road House online ordering service, you agree to be bound by these terms and conditions.
To provide the correct and complete delivery address and any other details at the time of ordering. Should you provide the wrong details, The Rocky Road House is not obliged to re-deliver the order to the correct address at our expense. All invoices that we issue (that you view before paying) contain the name and address details that we were given by you for delivery.
